Please read these Terms and Conditions carefully before using the 1-D-1 Companion mobile application ("App") or visiting 1d1companion.com ("Site"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. About the App
1-D-1 Companion is a wildlife management documentation tool designed to help Texas landowners log activities and generate annual reporting packets for the Texas 1-D-1 Open-Space Wildlife Management Appraisal. The App is owned and operated by Joy Lanham ("we," "us," or "our").
2. Eligibility
You must be at least 18 years old and a legal resident or citizen of the United States to use this App. By using the App, you represent and warrant that you meet these requirements.
3. User Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.
4. Subscriptions and Billing
Certain App features - including annual report export - require a paid subscription. Subscriptions are billed through the Apple App Store or Google Play Store according to the pricing displayed at the time of purchase.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may cancel at any time through your App Store or Google Play account settings.
Refunds are governed by Apple or Google's refund policies. We do not process refunds directly. Subscription prices may change with reasonable advance notice.
5. Your Data and Content
You own your data. All property information, activity logs, photos, and documents you enter into the App remain yours. We do not sell your personal or property data to third parties.
By using the App, you grant us a limited license to store and process your data solely for the purpose of providing App functionality - including generating your annual report and syncing your data across devices. This license ends when you delete your account.
You are responsible for the accuracy and completeness of the information you enter. Errors in your submitted data may affect your appraisal status.
6. No Legal, Tax, or Appraisal Advice
1-D-1 Companion is a documentation and organizational tool. Nothing in this App or on this Site constitutes legal advice, tax advice, appraisal advice, or wildlife management consulting.
Important: Use of this App does not guarantee that your property will qualify for, or maintain, the 1-D-1 Wildlife Management Appraisal. Qualification is determined solely by your County Appraisal District (CAD) and is subject to Texas law, TPWD guidelines, and your county's specific requirements. Always consult your CAD and a qualified wildlife professional.
7. Prohibited Uses
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations
- Submit false, inaccurate, or fraudulent information
- Attempt to access, reverse engineer, or tamper with any portion of the App's code or infrastructure
- Use automated tools (bots, scrapers) to access or extract data from the App
- Interfere with or disrupt the App's servers or networks
8. Intellectual Property
All App content, features, design, and underlying technology are owned by Joy Lanham or licensed to us. You may not copy, reproduce, distribute, or create derivative works from any portion of the App without our express written consent.
9. Third-Party Services
The App integrates with third-party platforms including Firebase (data storage and authentication), RevenueCat (subscription management), Apple App Store, and Google Play Store. Your use of those platforms is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.
10. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or that it will meet your specific requirements. We make no guarantee that reports generated by the App will be accepted by any County Appraisal District.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Joy Lanham and 1-D-1 Companion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of appraisal status, lost revenue, or data loss, arising from your use of or inability to use the App - even if we have been advised of the possibility of such damages.
12. Indemnification
You agree to indemnify and hold harmless Joy Lanham, 1-D-1 Companion, and any affiliated parties from any claims, damages, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of the App, your violation of these Terms, or your violation of any law or third-party rights.
13. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the App settings. Upon termination, your right to use the App ends immediately. Data deletion requests will be honored in accordance with our Privacy Policy.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via in-app notice or email. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Midland, Texas.
